U.S. Court of Appeals for the Federal Circuit issued a stay Thursday that keeps Section 122 tariffs at 10 percent in place while litigation continues. U.S. Trade policy. President Donald Trump introduced a range of tariffs on imports in 2025 to encourage domestic manufacturing and address trade imbalances.
A coalition of more than 20 states led by Oregon, joined by small businesses Burlap & Barrel and Basic Fun, filed the underlying challenge to the tariffs’ legality.
The court acknowledged that businesses may face operational and financial strain from paying the tariffs, including lost profits and constraints on growth. Newsweek reported that the court’s order allows importers to face the higher costs again during the appeal, with those costs likely to move through supply chains.
The same reporting noted that companies often pass part of the added expense to consumers, which could raise prices for certain imported goods in the short term.
