Luetto, a partner at Blank Rome’s Matrimonial & Family Law Group, stated that such agreements often include provisions where the wealthier party pays household costs.
She noted that the couple’s estates contain intellectual property and assets that are difficult to value and divide.
Luetto explained that the agreement could allow Swift to gift or transfer portions of her estate to Kelce or to community property. The amounts transferred could increase over time based on the length of the marriage. The lawyer added that the prenup would likely keep their estates separate to simplify any future dissolution.
Both parties would retain their own assets regardless of contributions made during the marriage.
The agreement may also permit joint ventures or shared asset purchases, with ownership interests clarified on a case-by-case basis. Luetto said the couple could include choice-of-law provisions given their multiple residences across states. Swift owns homes in New York City, Rhode Island, Nashville, and Los Angeles.
Kelce has properties in Leawood, Kansas, Kansas City, Missouri, and shares a home with family in Orlando, Florida. Luetto stated that the prenup could include non-disparagement or non-disclosure terms to protect privacy. Swift and Kelce became engaged in August 2025 and plan to marry this summer.
