Colorado Officials Face Federal Investigation Request Over Election Official's Sentencing
A conservative legal group asked the Justice Department to investigate state officials for their handling of a former county clerk's criminal case. The request follows a governor's decision to commute the clerk's nine-year sentence.
The Article III Project sent a letter to the department on Monday stating that officials targeted the clerk because of her public statements on election integrity. The group asked officials to examine the roles of a state judge, the state attorney general, a county district attorney, and the secretary of state.
Background on the Case The former clerk was convicted in 2024 on felony and misdemeanor charges after sharing voting machine passwords with political allies in 2021. A state judge sentenced her to nine years in prison. Colorado's appeals court ordered resentencing in April after finding that the original sentence improperly considered the clerk's protected speech.
On May 15 the governor commuted the sentence, setting a release date for the following Monday.
The district attorney stated that the clerk received a grand jury indictment, an impartial jury, legal representation, and a conviction based on evidence presented in open court. The attorney added that the commutation does not change the fact that she remains a convicted felon.
The clerk's legal team is seeking review by the state supreme court to overturn the convictions, according to The Denver Post.
