Court Rules Lady Donaldson Unfit to Stand Trial
A court in Northern Ireland has found Lady Eleanor Donaldson unfit to stand trial on mental health grounds. She will instead face a trial of facts under local mental health law.
The BbcA court in Northern Ireland has declared Lady Eleanor Donaldson unfit to stand trial on mental health grounds. The ruling came after medical evidence was presented at Newry Crown Court on Wednesday. Lady Donaldson, 60, and her husband Sir Jeffrey Donaldson, 63, face a combined 23 sex abuse charges.
Both deny the allegations. Sir Jeffrey Donaldson faces 18 charges including one count of rape and allegations of indecent assault and gross indecency between 1985 and 2008. Lady Donaldson denies five charges of aiding and abetting. In place of a standard trial, she will undergo a trial of facts under Article 49A of the Mental Health (Northern Ireland) Order 1986.
A jury in such proceedings determines whether the alleged acts occurred but cannot convict the defendant.
A consultant psychiatrist who examined Lady Donaldson testified via video link. The doctor stated that Lady Donaldson is unable to instruct lawyers, follow proceedings, or give evidence.
Prosecutors proposed that Sir Jeffrey Donaldson face a standard trial starting next Tuesday while his wife simultaneously faces the trial of facts. The judge will decide on Thursday whether the two proceedings should run together or separately.
