Democratic Lawmakers File Impeachment Resolution Against Education Secretary

The resolution states that Congress created the Department of Education and only Congress can dismantle it. It claims the transfers obstruct the department's ability to conduct statutory oversight and disburse federal funds appropriated under Article I of the Constitution.
The impeachment effort follows an announcement that the department's Office for Civil Rights duties will move to the Justice Department and its special education office will transfer to the Department of Health and Human Services.
The post noted chronic failures in the education system, including low test scores, a failed FAFSA rollout, and classrooms shuttered during COVID. The secretary stated that Washington has spent more than $3 trillion on the department since its establishment in 1980, yet only one-third of children can read proficiently.
The legislation is cosponsored by 16 fellow Democrats.
A Republican chair of the House education committee described the move as political theater in a statement to media. Higher Ed Dive reported that the resolution is unlikely to advance in a Republican-controlled Congress.
