The minister cited Swazi customary law, which does not recognize same-sex relationships. In August 2025 the group returned to court to contest those grounds. Sisanda Mavimbela, co-director of programmes and advocacy for the group, has continued preparing court documents in Manzini, Eswatini's second-largest city.
