EU Pay Transparency Directive Deadline Passes With Partial National Compliance

The EU Pay Transparency Directive entered into force on June 7, 2026. It requires employers with 100 or more staff to disclose pay ranges before hiring, report gender pay gaps, and take corrective action when gaps exceed 5 percent without justification.

Workers will know what a role pays before applying. The burden of proof in discrimination cases shifts to employers. A spokesperson said the directive aims to ensure equal pay for equal work.

Only a handful of member states met the June 7 deadline to transpose the directive into national law. Officials described the process as dynamic in several capitals, with legislative debate ongoing. Where countries miss the deadline, infringement proceedings can begin under Article 258 of the Treaty on the Functioning of the EU.

Fines for non-compliant companies must be effective, proportionate, and dissuasive.

Eurostat data shows women's average gross hourly earnings across the EU stood 11.1 percent below men's in 2024. The gap has changed little in a decade. The directive generates pay data by job category, grade, hours, contract type, and location. This information could be used to examine pay differences affecting younger, migrant, disabled, and racialised workers.

Most EU states restrict employers from collecting data on race or ethnicity. The directive does not require demographic categories beyond gender. Research from the European Trade Union Institute found workers in Central and Eastern EU states receive up to €1,000 less per month than German counterparts for comparable work within the same companies.
