Federal Court Pauses U.S. Vaccine Advisory Panel Operations
A federal court has issued an order halting the work of the Advisory Committee on Immunization Practices, citing issues with member qualifications. The ruling disrupts recommendations for vaccines including those for COVID-19, flu, and RSV, and creates uncertainty for insurance coverage. Prior guidance has been reinstated on an interim basis while litigation continues.
theweek.comA U.S. The order, issued by a federal judge of the District of Massachusetts, found that most members appointed under the Health and Human Services Secretary were likely unqualified. It blocks the panel from issuing new recommendations and reinstates previous immunization guidance temporarily.
In September 2025, five additional members were added without rigorous vetting. In a typical year, ACIP reviews and updates recommendations for COVID-19 and flu vaccines at its June meeting. Seasonal flu vaccines have a long-standing universal recommendation and may not require a new ACIP vote.
COVID-19 vaccines are modified annually and have a shorter track record, making their recommendation status unclear under the current halt. Several FDA-approved vaccines are now awaiting ACIP recommendations they may not receive. A long-running ACIP review of whether fewer HPV vaccine doses could still prevent cervical cancer has also been paused.
AHIP, the health insurance trade organization, has committed to covering all vaccines recommended by ACIP as of September 1, 2025, through the end of 2026. Coverage decisions beyond that period remain uncertain. The halt extends to pipeline products.
Moderna’s experimental mRNA-based flu vaccine awaits an FDA decision expected by early August and could enter the market without a federal recommendation if approved. Pfizer and Valneva SE’s Lyme disease vaccine, which showed about 70% efficacy in a late-stage trial, faces a similar situation if it receives FDA approval.
