Former CIA Director John Brennan filed a lawsuit on June 24, 2026, in the U.S. District Court for the District of Columbia against President Trump, Acting Attorney General Todd Blanche, FBI Director Kash Patel, and unnamed Florida prosecutors. The 46-page complaint requests a preliminary injunction ordering the preservation of records from two criminal investigations.
One investigation concerns whether Brennan made false statements to Congress regarding the intelligence community's 2017 assessment of Russian interference in the 2016 election. The second investigation examines whether former law enforcement and intelligence officials conspired to undermine Trump during that inquiry. No charges have been filed in either case.
The complaint states that Brennan is being "vindictively singled out for investigation" and alleges that some current DOJ and FBI leaders have converted the department into a tool of retribution. Brennan's attorneys cited more than 100 verbal or written statements by President Trump since 2017 criticizing Brennan.
As of May, FBI agents had interviewed roughly a dozen current and former CIA officials as part of the probe.
Joseph diGenova was appointed by Acting Attorney General Blanche to lead one of the investigations, with Kurt Olsen and John Yoo also involved. The Department of Justice has denied claims of weaponization of the justice system.
Brennan served as CIA director from 2013 to 2017 after nomination by former President Obama.
