State Department regulations already bar visitor visas when the primary purpose is to give birth in the United States for citizenship. Gill stated that birth tourism is illegal under current law and described the practice as an obvious abuse of the immigration system. His panel has been examining such companies since at least 2025.
A Spanish-language billboard in Mission, Texas promoted the now-defunct “Have My Baby In Texas” website and listed birth prices of $3,950 and Caesarean sections for $5,525 at Mission Regional Medical Center. The sign included an international phone code and prompted the State of Texas to open its own investigation of the hospital.

Gill said birthright citizenship was intended for former slaves and their children when the Fourteenth Amendment was ratified in 1868.
