The agency said it plans to keep him in custody pending removal and issued a press release on the arrest on June 15. Gabiev, an illegal alien from Russia, entered the United States in 2022 and was released by the Biden administration, according to the New York Post.

He was 32 at the time of the March 2024 incident. On March 5, 2024, Gabiev collided with Timmy J. m. A state trooper found the trailer on its side and engulfed in flames.
Medics pronounced Tarnowski dead at the scene. Gabiev was watching a YouTube video on an iPad while driving. When the trooper approached the vehicle, the iPad was still playing. Gabiev told officers he was listening to a program teaching him English and claimed he had not been looking at the device.
Gabiev was charged with criminal vehicular homicide and reckless driving. He pleaded guilty to criminal vehicular homicide and received a six-month prison sentence. A judge spared the prison term, resulting in 69 days in jail after credit for time served, three years of probation, a safe-driving course, and payment of $5,437 to Tarnowski’s family.
Gabiev spent 120 days in jail, according to the ICE press release. ” DHS Secretary Markwayne Mullin stated, “If it weren’t for the Biden administration’s open border policies, this tragedy would never have happened, and Tim would still be alive. This is our why.
