Israeli High Court Questions Justice Minister on Failure to Fill Judicial Vacancies
Israel's High Court of Justice held a hearing on the justice minister's refusal to convene the Judicial Selection Committee fully. Justices focused on shortages in district courts, particularly in Beersheba. The minister plans limited appointments, but critics argue this does not address the broader crisis.
mondoweiss.netIsrael's High Court of Justice conducted a hearing on Sunday regarding a petition about the justice minister's refusal to convene the Judicial Selection Committee to fill judicial vacancies. The session involved justices questioning the minister's lawyer on why partial appointments were sufficient amid staffing shortages in district courts.
Justices highlighted issues in the Beersheba District Court, where there is no permanent president and seven judges are missing. One justice noted that the southern district lacks about a quarter of its district court judges, impacting the handling of criminal cases.
The justice added that without sufficient judges, serious-crime panels cannot operate effectively. The lawyer responded that no court in Israel is paralyzed and urged the court not to intervene in the minister's discretion.
and Responses Justice Minister Yariv
Levin announced plans to convene the committee for limited appointments to traffic, family, and juvenile courts, along with some magistrates' court posts in northern districts. He scheduled a meeting for June 7, with additional sessions in June and July.
The attorney-general stated that this proposal does not fulfill the duty to address all vacancies promptly. The court indicated it would issue a decision later, prioritizing district court needs over Supreme Court appointments for now.
Following the hearing, Constitution, Law and Justice Committee chairman MK Simcha Rothman stated that High Court justices had taken powers from the justice minister. The petition was filed by the Movement for Quality Government after the minister declined to convene the committee.
In February, the High Court issued a conditional order requiring an explanation for not convening the committee. General elections are expected on October 27, limiting the window for further committee actions after July 27.
