Kenya's National Assembly on July 9 notified the Court of Appeal of its intention to appeal a High Court ruling that declared President William Ruto's Cabinet unconstitutional, AllAfrica reported. The High Court last week found that the Cabinet violates Article 27(8) of the Constitution because more than two-thirds of its members are of the same gender. Justices E.K.
Ogola, Stephen Githinji and Jairus Ngaah issued the decision and gave the president 120 days to reconstitute the body. The current Cabinet comprises 18 men and seven women. To meet the two-thirds gender requirement without changing its size, at least nine women must be appointed, requiring two additional appointments.
Parliament is also seeking to suspend the High Court's directive requiring reconstitution within 120 days. The appeal seeks to overturn the decision and remains pending hearing and determination at the Court of Appeal.
