The weeklong hearing will give prosecutors their first major opportunity to present evidence against Tyler Robinson, 23, who is charged with aggravated murder in the Sept. 10 shooting.
Kirk was shot in the neck while speaking at Utah Valley University. Robinson has not entered a plea. Prosecutors intend to seek the death penalty if Robinson is convicted. They plan to introduce forensic analyses, surveillance video, witness statements, autopsy findings and alleged messages from Robinson during the hearing.
Authorities said DNA consistent with Robinson was found on the rifle trigger, a fired cartridge casing, two unfired cartridges and a towel used to wrap the weapon. Prosecutors also said Robinson left a note for his romantic partner stating he had the opportunity to kill Kirk and planned to take it.
Erika Kirk, who assumed leadership of Turning Point USA after her husband’s death, has pushed for public access to the proceedings.
She stated at his memorial service that she forgives the accused. Kirk’s parents, Robert and Kathryn Kirk, have largely remained out of public view since the shooting. Robinson appeared at a prior hearing in 4th District Court in Provo in December.
