Leeds Tribunal Rules NHS Policy on Transgender Staff Facilities Created Hostile Environment

A Leeds Employment Tribunal ruled this week that an NHS policy permitting transgender staff to use single-sex facilities according to their chosen gender created a hostile environment for female employees. The tribunal upheld the complaint of an unnamed Muslim woman working for the NHS in Leeds.

She argued she had been discriminated against and harassed because the policy allowed transgender colleagues to use showers and toilets designated for women. The employee referenced NHS England guidance first implemented in 2017. She stated that she had not encountered any transgender women in the facilities she used.

The tribunal concluded that the policy amounted to harassment based on biological sex. It determined that NHS England had not shown the policy was a proportionate means of achieving the aim of inclusion for transgender staff. The woman could receive up to £25,000 in compensation. Legal experts noted that similar claims could lead to substantial legal costs for individual NHS trusts.

England has not yet updated its 2017 guidance following a Supreme Court ruling that defined "woman" and "sex" under the Equality Act 2010 as referring to biological sex. Many NHS trusts continue to await further direction. An NHS England spokesman said the organization recognizes the need for revised guidance on single-sex spaces and will consider the tribunal's findings when developing a new policy.

Elizabeth McGlone, managing partner of Didlaw, the law firm that represented the claimant, said the ruling opens the door to large-scale group claims by women in public sector roles. Ministers have pledged to publish Equality and Human Rights Commission guidance on implementing the Supreme Court ruling before the end of the month.
