He has denied allegations of non-consensual intercourse. Manhattan District Attorney Alvin Bragg issued a statement the same day. Bragg said his office was "disappointed that the proceeding ended with a mistrial" but respected the outcome.
"We will consider our next steps in consultation with Ms. Mann, and in consideration of Harvey Weinstein’s pending sentencing following last year’s trial conviction for forcibly assaulting Miriam Haley," Bragg added. The mistrial declaration came almost a year after another New York jury was unable to reach a verdict on Jessica Mann’s accusations.
A jury first found Weinstein guilty of third-degree rape connected to Mann and Miriam Haley, a former “Project Runway” production assistant, in 2020. That 2020 conviction was overturned in 2024 by a New York state appeals court. The court ruled that the 2020 trial judge erred by accepting testimony based on allegations not tied to the case.
A separate jury convicted Harvey Weinstein of committing a first-degree criminal act against Miriam Haley in June 2025. Weinstein is imprisoned on a 16-year sentence for a rape conviction in California in 2022.
He has appealed the 2022 California rape conviction and faces up to 25 years behind bars for the conviction of abusing Miriam Haley. @DailyCaller reported that the judge overseeing the latest New York case ruled it a mistrial after the jury proved unable to decide.
