Mistrial Declared in Harvey Weinstein New York Rape Case After Jury Deadlocks 9-3
A New York judge declared a mistrial on 15 May 2026 after jurors deadlocked on whether the 74-year-old former film producer raped Jessica Mann in a hotel room in March 2013. One juror told reporters that nine jurors wanted to acquit Weinstein and three wanted to convict him. Weinstein, who is 74 years old, was seated in a wheelchair during the trial and showed no reaction when the mistrial was declared.
The month-long trial centered on whether Weinstein raped aspiring actress Jessica Mann more than a decade ago. Jessica Mann testified that she willingly had some sexual encounters with Weinstein but that he forced her to have unwanted sex in a hotel room in March 2013 despite her repeatedly saying no. Weinstein’s defense team maintained that the March 2013 encounter was consensual.
This was the third time a New York jury has considered the case against Harvey Weinstein. An appeals court in 2024 overturned Weinstein’s 2020 New York conviction for sex crimes because a judge improperly allowed testimony from women whose allegations were beyond the charges. Weinstein was indicted on new sexual assault charges in New York after the 2024 appeal.
A second trial took place in 2025 but ended in a mistrial after the jury deadlocked on the rape count. The first trial featured testimony from Jessica Mann, Miriam Haley, and Kaja Sokola. The second retrial centered on Haley and Mann while the third trial centered only on Jessica Mann’s allegation.
Manhattan District Attorney Alvin Bragg stated that prosecutors are determining whether to try the case again. " Alvin Bragg said prosecutors will consider next steps in consultation with Jessica Mann and in consideration of Weinstein’s pending sentencing in a separate sexual assault case. Jessica Mann stated: "This mistrial doesn’t in any way detract from the truth I told.
I chose to testify in three trials because I am telling the truth. " Weinstein’s lawyers stated the outcome shows how deeply public perception and prejudice surrounding Harvey Weinstein have become embedded in society. " Weinstein’s lawyers called on the Manhattan District Attorney’s Office to stop retrying the same case and focus on violent crime, chaos, and public safety issues in New York.
Dozens of women have accused Weinstein of sexual misconduct, including rape, since October 2017. Weinstein has been accused of sexual misconduct, assault, and rape by more than 100 women. Weinstein was convicted in California and is likely to spend the rest of his life in prison.
Weinstein was diagnosed with bone marrow cancer in 2024. Weinstein co-founded Miramax, whose films included Shakespeare in Love and Pulp Fiction. A group of women who accused Weinstein of sexual harassment and rape reached a $19 million settlement in 2020.
