Nursing Home Residents Die After Assaults by Roommates With Dementia

A 92-year-old man died two days after his roommate punched him twice at Sunrise Post Acute in Banning, California. The roommate, 77-year-old Sam Ato Timaloa, told police he acted because the victim was too loud. Attilio Cecchetto suffered blunt force facial trauma.

Timaloa had dementia and noise intolerance. The facility moved him eight times in four months before placing him with Cecchetto, whose dementia caused frequent moaning and yelling. A nurse aide found blood on the floor, walls, and ceiling.

Timaloa pleaded not guilty to assault; charges were upgraded to murder. A judge will decide as early as August whether he is competent to stand trial. PACS Group, owner of Sunrise Post Acute, denied negligence.

Spokesman Brooks Stevenson said the company strives to provide quality care. California regulators fined the home $120,000. Medicare issued a separate $62,810 penalty. In White Bear Lake, Minnesota, Gladys Lynch, 96, died five days after another resident pushed her inside the memory care unit at Harbor Crossing.

Lynch suffered a brain hemorrhage and fractures. The Minnesota Department of Health found the facility responsible for neglect after aides reported the other resident's ongoing aggression. Prosecutors declined charges.

Lynch's family filed a wrongful death lawsuit in June 2026. In Chesapeake, Virginia, Linda Twiddy suffered a 10-by-6-inch shin injury after being kicked by a male resident at The Vero at Chesapeake. She underwent three surgeries and a skin graft, never walked again, and died earlier this year.

The family lawsuit settled on confidential terms in June 2026. Virginia regulators cited the facility for failing to protect residents. Federal records show the Centers for Medicare & Medicaid Services cited nursing homes at least 700 times since 2024 for failing to protect residents from resident-to-resident abuse.
