A spokesperson for Miller said the congressman filed the lawsuit to defend his reputation against false and malicious allegations made by his ex-wife and her attorneys. The spokesperson added that the complaint states they knowingly spread untrue claims of abuse to national media outlets to damage his reputation and standing as a public official.
Zashin declined to comment because he is named in the suit. Under litigation immunity, attorneys generally receive protections for statements made in legal proceedings, and Zashin's team is expected to file a motion to dismiss. Miller previously filed a defamation suit in 2021 against former White House press secretary Stephanie Grisham after she wrote about being in an abusive relationship without naming him.
He voluntarily dropped that suit about two years later. A spokesperson for Moreno said Miller is attempting to silence her in the same manner as the earlier case. The spokesperson referenced photographs, a handwritten letter, and a sworn declaration that Miller's lawyers later retracted after admitting a witness was not present.
The Post previously reported that Miller's legal team acknowledged in an email that his girlfriend was not likely present during a Feb. 1 custody exchange, contrary to prior statements and a court hearing. Moreno's lawyers then demanded that Miller's team drop or amend the related protection order request.
The custody battle has included competing allegations between Miller and Moreno. Miller has maintained that the claims against him are untrue. The case continues in court as Miller prepares for the general election.
