The nomination followed Tulsi Gabbard's resignation as director of national intelligence, which she attributed to her husband's cancer diagnosis. Trump had earlier named Bill Pulte, head of the Federal Housing Finance Agency, to serve as acting director. Democrats refused to extend the Section 702 warrantless surveillance authority while Pulte remained in line for the acting role.
The House had already adjourned when the authority expired. The Senate is scheduled to return June 15. Warner said intelligence community leaders told him they are "terrified of showing him information" and that foreign governments expressed "huge concern" about Pulte assuming the post.
In a separate post, Trump said he opposes reauthorizing the surveillance authority unless an elections bill he has long supported is attached. Warner said he knows Clayton and believes he has "the right temperament," though he wants to question the nominee about maintaining election integrity.
Warner stated that the FISA expiration creates a "national security risk" and that responsibility for the lapse lies with President Trump because he did not put forward a confirmed nominee until after the deadline.
Warner said he hopes President Trump will ask Gabbard to remain until Clayton is confirmed or allow her deputy to assume the duties in the interim.
