The NFL Players Association and quarterback Brendan Sorsby will not pursue litigation against the NFL over the decision not to hold a supplemental draft in 2026, according to a memo sent to all 32 teams. Sorsby will instead prepare for the 2027 NFL Draft.
"We have confirmed with the NFLPA and Brendan Sorsby that there will be no further litigation regarding his entry into the NFL -- and that instead, Mr.
Sorsby will focus on his preparation for entry into the League via the 2027 NFL Draft," the memo reads. For purposes of League and CBA rules, Sorsby will be considered a draft-eligible player for 2027 and will not be eligible to sign an NFL Player Contract until after that draft concludes. The NCAA had ruled Sorsby ineligible after he wagered on college sports.
A Texas court later issued a temporary injunction that cleared his path to play at Texas Tech for the 2026 season. The Big 12 then filed in federal court seeking to punish Sorsby and Texas Tech, after which Sorsby withdrew his suit and declared for the supplemental draft. The NFL will not discipline Sorsby for currently known prior misconduct, an NFL source told Ian Rapoport.
The league retains the right to investigate his conduct beyond public filings and to consider college misconduct when setting discipline for any future violations. In a statement, Sorsby said: "I accept 100% responsibility for my actions. " He added that he has received help and is focused on recovery one day at a time while preparing for the 2027 draft.
Sorsby admitted to betting thousands of times on college and pro sports, with wagers totaling upward of $90,000, including 40 on Indiana football while he was on the team. ESPN ranked him as the top player in the NCAA transfer portal this offseason.
