Supreme Court Affirms Birthright Citizenship for Children of Unlawful Immigrants, Blocks Trump Order

The Supreme Court ruled June 30 in Trump v. Barbara that children born in the U.S. to parents who are unlawfully or temporarily present are citizens at birth under the 14th Amendment’s Citizenship Clause.
The decision blocked President Trump’s executive order seeking to deny citizenship to those children. Sen. , introduced the American Citizenship Act on July 14. The bill would limit birthright citizenship to children of U.S.
Citizens and lawful permanent residents. On July 16, Schmitt sent a letter to Secretary of State Marco Rubio and Homeland Security Secretary Markwayne Mullin. The letter requested the agencies investigate illegal grants of citizenship documentation to foreign diplomats’ children, implement policies to prevent future grants, identify recipients, and revoke the documents.
Federal policy has long treated children born in the U.S. to accredited foreign diplomatic officers as outside the 14th Amendment’s birthright citizenship guarantee. U.S. Citizenship and Immigration Services states that such children do not acquire citizenship at birth, though they may register for lawful permanent residence.
Schmitt cited public reporting and legal scholarship claiming that potentially thousands of diplomats’ children may have received citizenship records despite not being citizens at birth. The White House did not immediately respond to a request for comment.
