Supreme Court Allows Temporary Protected Status for Haitian and Syrian Nationals to Expire

The U.S. Supreme Court ruled June 25 in favor of the Department of Homeland Security, permitting the Trump administration to let temporary protected status for Haitian and Syrian nationals expire without an 18-month extension. TPS for both countries ends Wednesday, July 1, 2026.

Roughly 335,000 of the more than 1 million TPS recipients must leave the United States or risk arrest by federal immigration officers after that date, Washington Examiner reported. Haiti first received TPS in 2010 after a major earthquake, while Syria received it in 2012. Congress created the program in 1990, and the DHS secretary decides renewals every six to 18 months.

Homeland Security Secretary Markwayne Mullin stated on Fox News that recipients must depart. “You have to leave. We’re going to assist you in doing so, and if you choose not to, then we’ll pick you up and force you to leave,” Mullin said.

He added that the administration will provide deportation flights and approximately $2,100 to individuals returning to Haiti and Syria. White House deputy chief of staff for policy Stephen Miller described hundreds of thousands of Haitians who entered under the prior administration as illegitimate asylum-seekers. ,” Miller told reporters.

He stated that Haiti is a safe country for Haitians to return to. More than 470,000 Haitian immigrants were encountered at the U.S. border between February 2021 and September 2024, with 80,000 entering illegally and 390,000 intercepted at ports of entry, Washington Examiner reported.

As of March 2025, U.S. Citizenship and Immigration Services data showed 330,735 Haitians and 3,860 Syrians had been granted TPS. In September 2021, roughly 16,000 Haitian immigrants entered illegally from Mexico in Del Rio, Texas.
