Trump Appoints Kyle Diamantas as Acting FDA Commissioner After Marty Makary Resigns

During his tenure at Baker Donelson, Kyle Diamantas served as outside counsel for Planned Parenthood in Florida litigation regarding a property use dispute over a medical complex in Kissimmee, Florida.

MMB Properties, a cardiology practice in the same Kissimmee medical complex, sought to prohibit Planned Parenthood of Orlando from performing abortions based on property use restrictions barring outpatient surgical centers. White House Spokesman Kush Desai stated on May 13, 2026 that Kyle Diamantas was a junior legal associate assigned to the Planned Parenthood case by his superiors.

A source familiar with Diamantas stated that his name appears on some court documents but his signature does not because he withdrew from the case.
