U.S. Issues All EB-5 Unreserved Visas for Indian Applicants Through September, New Allocations Begin October 1
The State Department said all available EB-5 unreserved visas for Indian nationals were issued by June 5. New issuances are suspended until October 1.
NewsweekU.S. State Department announced on June 10 that all available EB-5 unreserved immigrant visas for applicants chargeable to India had been issued as of June 5. U.S. embassies and consulates cannot issue additional visas in that category to Indian applicants until October 1, when fiscal year 2027 begins.
The June 10 notice affects Indian applicants waiting for visa issuance abroad and some applicants already in the United States whose cases require an available immigrant visa number. It does not affect other employment-based categories, family-sponsored green cards, or the EB-5 reserved categories created under the 2022 law.
U.S. Workers. The State Department said 68 percent of EB-5 visas are allocated to unreserved categories. Unused reserved EB-5 visas from fiscal year 2024 could be made available to unreserved categories in fiscal year 2026 under the EB-5 Reform and Integrity Act of 2022.
Separate allocations for rural, high-unemployment, and infrastructure projects remain unaffected. The development follows the State Department’s earlier announcement that India had reached its fiscal-year limit in the EB-2 employment-based category.
The June 2026 Visa Bulletin warned that sufficient demand and increased number use for India in EB-5 unreserved could force retrogression or make the category unavailable.
Applicants whose cases are otherwise ready may now have to wait until October 1 for immigrant visas to be issued or permanent resident status approved. The State Department said visa issuance in the affected category may resume after that date when new fiscal year allocations become available.
