The decision sided with the Coalition for Independent Technology Research in its lawsuit against the State Department. The State Department imposed visa bans in December 2025 on five Europeans, including a former European Union commissioner and anti-disinformation activists.
Among those affected were Imran Ahmed, British CEO of the Center for Countering Digital Hate, and Clare Melford, co-founder of the Global Disinformation Index.
Both belong to the coalition. Secretary of State Marco Rubio stated on X that the policy targeted foreign nationals who censor Americans’ free speech abroad. Rubio said the banned individuals had led organized efforts to coerce American platforms to censor, demonetize, and suppress American viewpoints they oppose.

Carrie DeCell, a lawyer for the coalition at the Knight First Amendment Institute at Columbia University, said the ruling recognized the serious constitutional harms this policy is already causing. In a May 26 statement, the coalition said the policy has created a chilling effect, with researchers dropping out of conferences, opting out of travel, shifting topics, and stepping back from affiliation.
A State Department spokesperson stated that aliens involved or complicit in censoring American citizens must face appropriate consequences, adding that an American visa is a privilege, not a right.
