Customers Seek ASIC Investigation into Zone RV Collapse and Insolvent Trading Allegations
Customers who lost over $10 million in progress payments after the collapse of luxury caravan company Zone RV have launched a campaign urging the Australian Securities and Investments Commission (ASIC) to investigate former director David Biggar for alleged insolvent trading.
Sunshine Coast-based luxury caravan company Zone RV entered administration in December 2023, owing approximately $42 million to hundreds of creditors, including staff, suppliers, and customers. The company was placed into liquidation in January 2024, after which a Melbourne-based rival acquired its assets to maintain the brand.
Around 140 customers remain owed more than $10 million in progress payments, with individual amounts reaching up to $160,000 for caravans that were not delivered. As unsecured creditors, these customers may receive no repayment.
Liquidators from Cor Cordis have accused former director David Biggar of multiple breaches of the Corporations Act, including continuing to trade while insolvent for up to two-and-a-half years. The liquidators attributed the company's failure to poor financial management, periods without leadership in finance and operations, and reliance on customer installment payments to fund operations.
In December 2023, Biggar signed a loan agreement to personally provide up to $10 million to the company, but only loaned $2 million in June 2024 and repaid himself about $1 million in the weeks before the collapse. Biggar did not respond to requests for comment.
Affected customers have initiated a nationwide campaign calling on ASIC to investigate Biggar based on the liquidators' allegations. Gold Coast resident Natasha Daley, who lost $160,000 and represents about 70 customers owed nearly $7 million collectively, submitted a joint letter to ASIC requesting action.
Daley stated that she and her husband had retired and planned a trip around Australia, but now face returning to work for 12 to 18 months to recover funds.
“I'm feeling disgusted and angry ... there's been significant consumer harm.”
