The European Commission on Monday sent member states an information note dated 3 July that sets out why it believes Serbia's repeal of February judiciary laws meets conditions for opening Cluster 3 of accession talks. Some diplomats argue that recognising the repeal would reward compliance with Venice Commission recommendations; others say the move returns Serbia to its prior position without resolving issues raised in a confidential early-2025 Commission assessment.
The debate occurs after President Aleksandar Vučić announced plans to resign after eight years and call elections within three to four months. A Commission spokesperson stated that any decision on moving forward rests with the Council. The matter is expected to be discussed at a meeting of ambassadors in Brussels on Wednesday.
