The orchestra maintained a policy of not supporting either side in the Gaza conflict, and the court noted a custom among classical musicians against making unapproved political statements from the stage.
Gillham posted on Instagram on Saturday morning that he was very disappointed by the outcome. He wrote that artists should be free to speak with integrity and that his principles remain unchanged, adding that he would focus on music while considering the findings. The case followed a three-week trial that concluded in June 2026 and included testimony from about two dozen witnesses.
Orchestra chair Edgar Myer welcomed the ruling and said the organisation could now focus on music. The question of legal costs will be decided at a later date.
