Blanche said earlier this month that the indictment covers more than the single seashell photo. He described a body of evidence collected over about 11 months and noted he was not permitted to share other details publicly. Restaurant workers told NBC News last month that the phrase "86 it" is a common, non-violent term in the hospitality industry.

Comey declined to comment on the specifics of the case on Sunday, citing ongoing legal proceedings. He said Acting Attorney General Blanche should not speak publicly about the matter either. In a separate interview last week, Comey stated that targeting political opponents conflicts with the Justice Department's mission.

He referenced separate cases involving Adam Schiff, Letitia James, and Sen. Mark Kelly that did not advance. A separate indictment against Comey and James was dismissed last year after a judge found the prosecutor was wrongly appointed. Comey described the dismissed case as a case of political payback.
