A former Democratic commissioner of a federal civil rights agency dropped a lawsuit Monday challenging her dismissal, citing a recent Supreme Court ruling on presidential authority over independent agencies. The filing came after the court upheld the removal of agency heads, with the exception of the Federal Reserve, overturning a 91-year-old precedent.
The agency released a regulatory agenda Monday that includes ending annual collection of workforce demographic data from companies with 100 or more employees and federal contractors with at least 50 workers. The agenda also proposes rescinding guidance that warned against requiring workers to use only English on the job.
The commission now consists of two Republicans and one Democrat after earlier dismissals before the end of five-year terms. The agency has not yet received nominations to fill two open seats. The regulatory agenda further includes revisions to enforcement rules under the Pregnant Workers Fairness Act and removal of prior guidance on voluntary affirmative action programs.
A public comment period will follow commission approval of the data-collection change.
