Downstream, the Bureau of Land Management must now accept and process a formal right-of-way application from the project sponsor within 90 days and complete the National Environmental Policy Act review under a schedule set by the new law. The Federal Energy Regulatory Commission will incorporate the statute’s environmental stipulations into any certificate of public convenience and necessity it issues for the lateral.
Construction cannot begin until the BLM right-of-way grant and any required state permits are issued, but the statutory authorization removes the prior legal barrier that had blocked the project for more than a decade.
The measure originated as a stand-alone bill after earlier attempts to include the pipeline language in larger energy packages failed to advance. It passed both chambers by voice vote with no recorded opposition, according to congressional records attached to the enrolled bill.
The law represents the first adjustment to the Sloan Canyon National Conservation Area’s boundaries and management prescriptions since its original designation 24 years ago.
