Rochester Man Sentenced to 21 Months for Threatening Police Officer
Orlando Justice, 38, received a 21-month prison term after conviction on transmission of threatening communications in interstate commerce. The sentence triggers standard federal incarceration and supervised release requirements that now take effect immediately upon designation to a Bureau of Prisons facility.
ROCHESTER, N.Y. — Orlando Justice, 38, of Rochester was sentenced to 21 months in prison by U.S. District Judge Meredith A. Vacca after a conviction for transmission of threatening communications in interstate commerce.
The U.S. Attorney for the Western District of New York, Michael DiGiacomo, announced the sentence on May 13, 2026. Justice stalked and threatened a police officer, according to the Department of Justice release. The case was prosecuted in the U.S. District Court for the Western District of New York.
The sentence changes Justice's status from convicted defendant to federal prisoner. He will serve the full 21 months in a Bureau of Prisons facility yet to be designated, followed by a term of supervised release. Prior to sentencing he remained at liberty; the new state is immediate incarceration once the Bureau of Prisons assigns him.
Downstream, the ruling requires the Bureau of Prisons to designate a facility within weeks and begin the term. The U.S. Probation Office must prepare for post-release supervision once the 21 months concludes. The conviction also enters Justice's permanent federal criminal record, restricting certain federal benefits and firearms possession under longstanding statutes.
No fine amount or restitution figure was disclosed in the release.
This marks the latest federal prosecution of threats directed at law enforcement in the Western District of New York. The Department of Justice has pursued similar interstate threat cases under the same statute in multiple districts in recent years following increased reporting of officer-targeted communications during periods of public protest and political tension.
