Trump Family Refiles Capital One Lawsuit Alleging 2021 Account Closures

The Trump family refiled its lawsuit against Capital One on July 17, alleging the bank abruptly closed hundreds of accounts tied to entities affiliated with President Trump after the January 6, 2021, attacks on the Capitol, nypost.com reported. Eric Trump submitted the new complaint on behalf of The Donald J. Trump Revocable Trust.

The new complaint removed references to “woke” debanking that appeared in the original March 2025 filing. It instead noted bipartisan congressional scrutiny of debanking practices and referenced Sen. Elizabeth Warren.

U.S. District Judge Roy Altman had dismissed the first complaint for lacking specific details and set a July 2, 2026, deadline to refile, later extending it to July 17. Capital One had denied that political motivations drove any account decisions.

Eric Trump stated at the time of the original suit that changing more than 300 accounts created significant hardship. He said the accounts covered hotels, golf courses, residential and commercial buildings, retail outlets, skating rinks, and parking garages. “There was no political affiliation,” he added.

Sen. Warren sent a letter to Eric Trump earlier this month asking whether the family would refile and seeking clarification on its issues with Capital One. The letter also referenced the nomination of a Capital One executive to lead the Consumer Financial Protection Bureau.

As of the end of January 2026, the CFPB had about 1,200 employees, down roughly 30 percent from before President Trump took office.
