President Donald Trump halted the confirmation process for Jay Clayton on Wednesday. Clayton had been scheduled to appear before the Senate Intelligence Committee that day. U.S. Clayton currently serves as the top federal prosecutor in Manhattan. New York’s Democratic senators, Chuck Schumer and Kirsten Gillibrand, have not provided support for McDonald through the blue slip process.
Trump argued that he does not want to remove Clayton from his current role until a permanent replacement is installed. Section 702 of the Foreign Intelligence Surveillance Act lapsed last week. Senate negotiations over reauthorizing the provision have stalled amid disagreements over intelligence leadership.
Some Democrats had viewed Clayton as a compromise nominee for director of national intelligence and were open to discussing renewal if he replaced acting DNI Bill Pulte. Trump’s decision to pause Clayton’s nomination has cast additional uncertainty over those talks. Grassley said Senate practices and norms will only survive if there is good faith on all sides.
