He sat down for an exclusive interview with CBS News immigration correspondent Camilo Montoya-Galvez. Blanche, President Donald Trump’s former personal lawyer, addressed Obama’s remarks from an interview on The Late Show with Stephen Colbert that aired Tuesday night.
Obama told Stephen Colbert that the White House shouldn't be able to direct the attorney general to go around prosecuting whoever the president wants to prosecute.
Obama warned that America can't overcome the politicization of our justice system. The Justice Department announced late last month that a federal grand jury in North Carolina had indicted former FBI Director James Comey. The indictment charges Comey with violating 18 USC 871 by knowingly and willfully making a threat to take the life of, and to inflict bodily harm upon, the President of the United States.
It further charges that Comey publicly posted a photograph on Instagram that depicted seashells arranged in a pattern making out 86 47, which a reasonable recipient who is familiar with the circumstances would interpret as a serious expression of an intent to do harm to the President of the United States.
The other count in the Comey indictment is based on 18 USC 875, which makes it a felony to transmit an interstate communication that contains any threat to injure the person of another. An 11-month investigation produced a body of evidence that supports the federal indictment against James Comey.
Blanche said on NBC's Meet the Press last Sunday that the evidence goes beyond the May 15 Instagram post. Comey posted on social media in May 2025 a photo of seashells on the beach that read out 86 47. The May 15 Instagram post shared a photograph of seashells arranged in the sand to form the message 86 47.
U.S. Comey said in a video posted to Substack: "Well, they’re back. This time about a picture of seashells on a North Carolina beach a year ago.
And this won’t be the end of it. But nothing has changed with me. I’m still innocent. I’m still not afraid. U.S. Constitution says the executive power shall be vested in the President of the United States of America and it does not say that the Attorney General stands off to the side.
He said to the extent that President Trump calls him and says that he thinks that we have a problem in this country, whether it's the scourge of drugs or illegal immigration, every American wants him to do that and he should. Blanche said on Meet the Press: "I am not permitted to get into the details of what the grand jury heard or found.
" He said the slogan 86 47 is posted constantly and that phrase is used constantly.
He said there are facts, there are circumstances, there are investigations that have to take place regarding uses of the phrase 86 47. Over the past year, the Justice Department has charged dozens of cases involving threats against all sorts of individuals.
Diego M. Villavicencio pleaded guilty to two counts of sending interstate threats in the Northern District of Florida. Troy Kelly admitted in August that in May 2024 he posted a threat to kill President Biden on a social media website and that he intended it to be understood as a threat.
Sen.
) described the case against James Comey as looking like a vindictive prosecution because 86 47 cannot plausibly be considered a death threat. Tillis said on CNN: "I can't find any evidence where 86 is used as a call for violence. It better be more than just the picture.
