Geneva New York man charged with production and possession of child pornography

Rafael Arroyo-Ubiles, 27, of Geneva, New York, was arrested and charged by criminal complaint on May 7, 2026, in the U.S. District Court for the Western District of New York with production and possession of child pornography.

The single defendant faces a statutory maximum of 30 years in prison, a lifetime term of supervised release and a $250,000 fine. The U.S. Attorney for the Western District of New York, Michael DiGiacomo, announced the charges.

The charges mark the initiation of federal prosecution against Arroyo-Ubiles. Prior to the complaint, no charges existed in this matter. The case will now proceed through discovery, potential motions and either a plea or trial in the Western District of New York.

Downstream, the filing requires the U.S. Attorney’s Office to present evidence to a grand jury for indictment within 30 days under the Speedy Trial Act. If convicted, the court must impose sex-offender registration under the Sex Offender Registration and Notification Act.

The case also triggers mandatory forfeiture proceedings for any devices or materials used in the alleged production. Federal sentencing guidelines will apply, which for production offenses typically start at a base offense level of 32 and add enhancements for number of images, victim age and sadistic content.

This prosecution follows standard Department of Justice practice for child pornography cases investigated by Homeland Security Investigations or the FBI. The Department of Justice has brought similar production charges in the Western District of New York in prior years, each carrying the same 30-year maximum under 18 U.S.C. §§ 2251 and 2252.
